Terms of Service

1. Who we are and how to contact us

Comcroft Ltd (“ComCroft”) operates the commission marketplace at comcroft.com. We are a private limited company registered in England and Wales (company number 17236598). Contact us at support@comcroft.com.

2. What ComCroft is

ComCroft is an online marketplace connecting buyers with independent artists for paid creative commissions. We are not a party to the agreement between buyer and artist — we provide the platform, payment infrastructure, and dispute process. The artist is solely responsible for delivering the agreed work.

3. Accepting these Terms

By creating an account or using ComCroft, you agree to these Terms and our Privacy Policy. We may update them from time to time and will notify you by email, requiring re-acceptance before continued use.

4. Eligibility

You must be at least 18 years old to use ComCroft.

5. Accounts

You are responsible for keeping your credentials secure and must not share your account. We may suspend or terminate accounts that violate these Terms.

6. How payments work

ComCroft uses Stripe to process all payments. When you commission an artist:

  1. You authorise a card payment through Stripe. Your card is not charged at this point — funds are reserved but not captured.
  2. Stripe holds the authorised funds. ComCroft does not hold your money.
  3. Your card is only charged when you approve the completed work.
  4. On capture, Stripe transfers the artist’s full commission to their connected UK bank account. ComCroft collects its service fee separately via Stripe’s platform fee mechanism.

This is a delayed-capture payment model, not escrow. ComCroft is not a regulated payment institution — Stripe, authorised by the Financial Conduct Authority (FCA reference 900461), handles all regulated payment activity on our behalf.

If you do not respond to a delivery within 7 days, the commission will be automatically approved and your card will be charged.

7. Pricing and service fee

Artists set their own prices. On top of the commission, ComCroft charges the buyer a service fee of £1.00 plus 7% of the commission, shown clearly before payment is confirmed. The artist always receives their full agreed commission — the service fee is paid by the buyer on top. VAT on the service fee will be shown separately if applicable.

8. Artist payouts

Once a commission is approved, the artist receives their payout within 5 working days.

9. Cancellation and refunds

Before the artist accepts: You may cancel at any time — no charge.

After acceptance, before delivery: You may raise a dispute. If resolved in your favour, you are not charged.

After delivery: You may approve the work or request a revision.

After approval: Payment is final. Refunds are only considered where there is evidence of material breach by the artist.

10. Your right to cancel (Consumer Contracts Regulations 2013)

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers have a 14-day right to cancel a service contract. By proceeding to payment, you waive this right once the artist has begun work on your commission.

11. Disputes

Disputes may only be raised before you approve the completed work, or where there is evidence of material breach (work entirely different from what was agreed, infringing work, or failure to deliver where time was of the essence). Raise disputes through the platform. ComCroft’s decisions are final and binding.

12. Prohibited content and conduct

The following are strictly prohibited on ComCroft and may result in immediate account termination:

  • NSFW content: Commissioning or delivering sexually explicit, graphic, or otherwise not-safe-for-work material of any kind is not permitted.
  • AI-generated work: Delivering or commissioning work that is fully or partially generated by artificial intelligence tools is not permitted.
  • Commissioning or delivering illegal or infringing content
  • Paying artists outside the platform for work originating from a ComCroft introduction
  • Creating fake reviews or manipulating ratings
  • Harassing, threatening, or abusing other users
  • Attempting unauthorised access to the platform or other users’ accounts

ComCroft reserves the right to terminate accounts and withhold pending payouts where these prohibitions are violated.

13. Intellectual property

The artist retains all intellectual property rights until payment is received in full. On full payment, the artist grants the buyer a perpetual, worldwide, non-exclusive licence for the purposes described in the brief. Copyright transfer requires explicit written agreement. ComCroft claims no rights over any work created through the platform.

14. Our liability

ComCroft is a marketplace, not a service provider, and is not responsible for the quality of work delivered. Our total liability to you shall not exceed the service fees you paid in the 12 months preceding your claim. We are not liable for loss of profits, loss of business, or indirect losses. Nothing here limits liability for death or personal injury from our negligence, fraud, or liability that cannot be excluded under English law.

15. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
